These terms are the agreement between you and The Gamers Center LLC ("we", "us") for your member account, your founding membership if you have one, and the use of our website and, once we open, the center. You accept them by ticking the box when you create your account.
You must be at least 13 to create an account online. If you are 13 to 17, a parent or guardian must confirm your account by email; they are responsible for it and for any fee paid on it. Under 13? Come and see us with a parent or guardian when we open.
Give us accurate information, keep your password to yourself, and keep one account per person. Your username may be shown in public (the Founders Wall, leaderboards, screens at the center), so it must not be offensive; we may ask you to change one that is, or change it for you.
A founding membership is a customer membership tier that gives you the benefits listed for your tier on our founders page. It is not an ownership interest in The Gamers Center LLC, a loan, an investment, or a vote in how the business is run.
Founder fees are refundable in full at any time until grand-opening day, and are not refundable after it. If we do not open, every founder fee is refunded in full. Renewal fees are not refundable once paid. See the Refund Policy for how to ask.
The opening timeline on our founders page is a target, and it may move. Your refund right in section 6 protects you if it does. Once a benefit year is paid, its tier and benefits are fixed for that year. Any change to founder benefits takes effect only at the next renewal, and we tell you what is changing before you decide whether to renew.
Money you add to your account is for play and purchases at the center. It has no cash value except where the law requires otherwise. See the Refund Policy.
House rules are posted at the center and apply to everyone. We may suspend or end an account for abuse, cheating, harassment, damage to equipment, or breaking the law, and in that case any unused prepaid balance is handled as described in the Refund Policy. A separate participation waiver is signed at the center; for members under 18 a parent or guardian signs it.
We provide the center and this site with reasonable care, but not with any promise that they will always be available or error-free. To the extent California law allows, our liability to you for anything arising from this agreement is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that the law does not let us limit.
California law governs this agreement, and any dispute about it is heard in the courts of Stanislaus County, California.
